ARTICLE 1.  SCOPE

1.1  Who We Are. This Privacy Policy (this "Policy") describes how Pristine Industrial Roofing LLC ("PIR," "we," "us," or "our") collects, uses, shares, and protects information about individuals.

1.2  What This Policy Covers. This Policy applies to information collected:

(a)through every PIR Property, as defined in PIR's Terms of Service and listed in Schedule A of those Terms;

(b)by telephone, text message, email, and video meeting;

(c)in person, including during roof evaluations, project work, and events; and

(d)from the other sources described in Article 5.

1.3  Relationship to Other Terms. This Policy is incorporated into PIR's Terms of Service. A signed Service Agreement may contain additional terms about project information, which control for that project.

1.4  Exclusion. This Policy does not cover information about PIR's own employees, contractors, or job applicants, which is handled under separate notices.

ARTICLE 2.  DEFINITIONS

2.1  Defined Terms. In this Policy:

(a)"Personal Information" means information that identifies, relates to, or can reasonably be linked to an individual. It does not include information that has been de-identified or aggregated so that it can no longer reasonably be linked to an individual.

(b)"Tracking Technologies" means cookies, pixels, tags, web beacons, software development kits, scripts, local storage, session replay tools, and similar technologies.

(c)"Service Provider" means a company or individual that processes Personal Information on PIR's behalf to perform services for PIR.

(d)"Advertising Partner" means an advertising, social media, or analytics platform that receives information through Tracking Technologies on the PIR Properties.

2.2  Interpretation. "Including" means "including without limitation." Capitalized terms not defined here have the meanings given in PIR's Terms of Service.

ARTICLE 3.  INFORMATION YOU PROVIDE

3.1  Categories. We collect information you provide to us, including:

(a)contact information, such as name, company name, title, telephone number, email address, and mailing address;

(b)property information, such as property address, building type, roof size, roof type and condition, your role in the property (owner, manager, tenant, or maintenance), and your priorities and timeline;

(c)photographs, video, drawings, documents, and descriptions you send us;

(d)the content of messages, calls, texts, emails, and meetings with us;

(e)information about other people you ask us to include in the conversation, such as a business partner, property manager, or landlord;

(f)insurance claim information, such as carrier, claim number, adjuster contact, and loss details, when you ask for our help documenting a claim;

(g)information needed to process orders and payments, such as billing contact and order details; and

(h)reviews, testimonials, survey responses, and feedback.

3.2  Information About Others. If you give us information about another person, you represent that you have that person's permission to do so.

3.3  Payment Card and Bank Information. Card and bank account numbers are entered on secure payment pages operated by our payment processor and are not stored by PIR.

3.4  Information We Do Not Want. Please do not send us Social Security numbers, government identification numbers, or health information. We do not request them.

ARTICLE 4.  INFORMATION COLLECTED AUTOMATICALLY

4.1  Device and Usage Information. When you visit a PIR Property, open our emails, or interact with our ads, we and our Advertising Partners automatically collect information, including IP address, device type, operating system, browser type, approximate location derived from IP address, referring website, pages and content viewed, links clicked, time spent, search terms, and the ads you saw or clicked.

4.2  Form Activity. Our forms may capture information you type, including partially completed entries, before you press submit, so that we can follow up on an inquiry that was interrupted.

4.3  Session Activity. We may use session replay tools that record mouse movements, clicks, scrolling, and page interactions to help us understand how visitors use the PIR Properties and to fix problems.

4.4  Email and Text Activity. Our emails and text messages may contain Tracking Technologies that tell us whether a message was opened or a link was clicked.

4.5  Call Tracking. We may use tracking telephone numbers that record which ad or page led to a call, along with the caller's number, the time, and the length of the call.

ARTICLE 5.  INFORMATION FROM OTHER SOURCES

5.1  Sources. We obtain information about commercial properties and the people associated with them from other sources, including:

(a)public records, such as property records, parcel data, permit records, and business registrations;

(b)lead marketplaces and inspection auction platforms;

(c)data and list providers, business directories, and mapping and aerial imagery services;

(d)public social media profiles and business websites;

(e)general contractors, property managers, referral partners, and other clients who refer you to us; and

(f)Advertising Partners, which may provide information about the audiences that see or respond to our ads.

5.2  Combination. We may combine information from these sources with information you provide and information collected automatically.

ARTICLE 6.  HOW WE USE INFORMATION

6.1  Purposes. We use Personal Information to:

(a)respond to inquiries, qualify requests, and schedule roof evaluations;

(b)evaluate properties and prepare scopes of work, proposals, and reports;

(c)perform, document, and warranty projects, and process orders, deliveries, and returns of materials;

(d)send appointment confirmations, project updates, and service information;

(e)identify commercial properties that may need our services and reach their owners and managers by mail, telephone, email, text where permitted, and advertising;

(f)show our ads on other websites and platforms to people who have visited the PIR Properties or who resemble our clients, and measure how those ads perform;

(g)send educational content, newsletters, and offers;

(h)analyze and improve the PIR Properties, our content, and our services;

(i)train and coach our team, including through review of recorded calls;

(j)detect and prevent fraud, spam, and security incidents;

(k)comply with law and enforce our agreements; and

(l)carry out any other purpose disclosed to you when the information is collected.

6.2  Software and Automated Tools. We use software tools, including artificial intelligence tools, to organize information, draft communications, transcribe calls, and prepare documents. Those tools process Personal Information under the Service Provider terms described in Article 8.

ARTICLE 7.  COOKIES, PIXELS, AND ADVERTISING

7.1  Types of Tracking Technologies. The PIR Properties use the following categories of Tracking Technologies:

(a)essential technologies, which make the PIR Properties work, keep them secure, and remember your choices;

(b)analytics technologies, which measure traffic and how visitors use the PIR Properties;

(c)advertising technologies, which allow Advertising Partners to show you PIR ads on other websites and platforms, build audiences, and measure results; and

(d)functional technologies, such as address autocomplete, embedded video, scheduling tools, and chat features.

7.2  Advertising Partners. Our current Advertising Partners are listed in Schedule A. We may add or change Advertising Partners at any time by updating Schedule A. Advertising Partners may collect information directly through their own Tracking Technologies, may combine it with information they hold about you, and use it under their own privacy policies.

7.3  Embedded Video. Videos on the PIR Properties may be hosted and played by third party platforms such as YouTube, which collect information about your viewing under their own privacy policies.

7.4  Your Controls. You may limit Tracking Technologies by:

(a)using the cookie preferences tool on the PIR Properties, where available;

(b)blocking or deleting cookies in your browser settings;

(c)adjusting ad preferences in your account settings on each platform;

(d)using the industry opt out tools at optout.aboutads.info and optout.networkadvertising.org; and

(e)installing Google's Analytics opt out browser add on.

7.5  Global Privacy Control. Where required by applicable law, we treat a Global Privacy Control signal from your browser as a request to opt out of targeted advertising for that browser.

7.6  Do Not Track. Because no uniform standard exists, the PIR Properties do not respond to browser "Do Not Track" signals other than as stated in Section 7.5.

ARTICLE 8.  HOW WE SHARE INFORMATION

8.1  Recipients. We share Personal Information with:

(a)Service Providers, including providers of customer relationship management, marketing automation, website hosting, email and text delivery, telephone and call recording, scheduling, project photo documentation, payment processing, bookkeeping, data storage, and software tools, examples of which are listed in Schedule B;

(b)Advertising Partners, as described in Article 7;

(c)manufacturers and suppliers, including Conklin, to ship materials directly to you, register warranties, and arrange inspections;

(d)insurance carriers, adjusters, and their representatives, when you ask us to document a claim;

(e)financing partners, when you ask us to connect you with financing;

(f)general contractors, property managers, owners, and tenants involved in your project;

(g)our attorneys, accountants, insurers, and other professional advisers;

(h)government authorities, courts, and others when we believe disclosure is required by law, or necessary to protect the rights, property, or safety of PIR, our team, our clients, or the public; and

(i)a buyer, successor, or financing source in connection with any merger, acquisition, financing, or sale of all or part of our business.

8.2  No Sale for Money. We do not sell Personal Information in exchange for money. Some state laws treat the use of advertising Tracking Technologies as a "sale" or "sharing" of Personal Information. You may opt out of that activity as described in Articles 7 and 13.

8.3  Referral Compensation. If we connect you with a financing partner at your request, we may receive a referral fee from that partner.

ARTICLE 9.  TEXT MESSAGES

9.1  Consent. If you provide your mobile number and agree to receive texts, we may send text messages about your inquiry, appointments, projects, and offers, as described in Article 11 of our Terms of Service. Consent is not a condition of purchase.

9.2  Rates and Opt Out. Message and data rates may apply. Message frequency varies. Reply STOP to opt out or HELP for help.

9.3  No Sharing of Mobile Consent. We do not share or sell mobile telephone numbers, text messaging opt in data, or text messaging consent with any third party for that party's own marketing purposes. Sharing with Service Providers that deliver our messages is not excluded by this Section.

ARTICLE 10.  CALLS AND RECORDINGS

10.1  Recording. Calls and video meetings with PIR may be monitored, recorded, and transcribed for quality, training, and record keeping. We give notice at the start of recorded calls where required by law.

ARTICLE 11.  PHOTOGRAPHS AND PROJECT DOCUMENTATION

11.1  Documentation. We photograph and record video of roofs and buildings, including by drone, to evaluate conditions, document work, and support warranties and insurance claims.

11.2  Incidental Capture. Photographs, video, and aerial imagery may incidentally capture people, vehicles, and neighboring property. We do not use such incidental images to identify individuals.

11.3  Marketing Use. We may use project photographs and video in marketing. We do not publish a client's personal name with them without written consent. We may identify a property by its business name or general location.

ARTICLE 12.  INTERNATIONAL PROCESSING

12.1  Team and Providers Outside the United States. Members of our team, our contractors, and our Service Providers may be located in, and may access Personal Information from, countries outside the United States. Those countries may have data protection laws different from those of the United States. We require everyone who handles Personal Information on our behalf to protect it consistent with this Policy.

ARTICLE 13.  YOUR CHOICES AND RIGHTS

13.1  Marketing Choices. You may at any time opt out of text messages by replying STOP, opt out of marketing emails by using the unsubscribe link, opt out of marketing calls or mail by contacting us, and limit advertising as described in Section 7.4. We may still send you messages about an active project or transaction.

13.2  Requests. You may ask us to:

(a)confirm whether we hold Personal Information about you and provide a copy;

(b)correct inaccurate Personal Information;

(c)delete Personal Information;

(d)opt out of targeted advertising and any "sale" of Personal Information as defined by applicable law; and

(e)stop using your information for prospecting outreach.

13.3  How to Make a Request. Send requests to the contact information in Article 19. We will verify your identity before acting on a request and may ask for information to do so. An authorized agent may submit a request on your behalf with proof of authority.

13.4  Response. We will respond within forty five (45) days, or within any shorter period required by law. We may retain information we are required to keep by law, needed to complete a transaction, or needed to establish or defend legal claims, including warranty records.

13.5  Appeal. If we decline your request, you may appeal by replying to our decision with the word "Appeal." We will respond to your appeal in writing within the period required by law.

13.6  No Discrimination. We will not deny you service or charge you a different price because you exercised a right under this Policy.

ARTICLE 14.  RETENTION

14.1  Retention Period. We keep Personal Information as long as reasonably necessary for the purposes in this Policy. Project, warranty, and transaction records are kept for the life of any warranty plus the time to bring related legal claims. Prospect and marketing records are kept until they are no longer useful or you ask us to delete them.

ARTICLE 15.  SECURITY

15.1  Safeguards. We use reasonable administrative, technical, and physical safeguards to protect Personal Information. No system is completely secure, and we cannot guarantee security.

15.2  Breach Notice. If a security breach affects your Personal Information, we will notify you and any required authorities as required by applicable law.

ARTICLE 16.  CHILDREN

16.1  Adults Only. The PIR Properties are intended for adults eighteen (18) years of age and older and are not directed to children. We do not knowingly collect Personal Information from children under thirteen (13). If you believe a child has given us information, contact us and we will delete it.

ARTICLE 17.  THIRD PARTY WEBSITES AND PLATFORMS

17.1  Not Covered. This Policy does not apply to websites, platforms, or services operated by others, including those linked from the PIR Properties or on which our content appears. Their own privacy policies govern them.

ARTICLE 18.  CHANGES TO THIS POLICY

18.1  Updates. We may update this Policy by posting a revised version and updating the Last Revised date. If we make a material change to how we use Personal Information already collected, we will provide notice as required by law.
